Cancellation policy & cancellation form

This cancellation policy applies to all products purchased from us on https://livindahome.ch/ (see A. Cancellation policy – all purchases except sofas); for the purchase of a sofa, we grant an extended cancellation period of 30 days (see B. Cancellation policy – purchase of a sofa). The cancellation form applies in all cases (see C. Cancellation form).

Consumers have a right of withdrawal in accordance with the following provisions; a consumer is any natural person who enters into a legal transaction for purposes that are predominantly outside their trade, business or self-employed profession:

Right of withdrawal

You have the right to withdraw from this contract within fourteen days without giving any reason.

The withdrawal period is fourteen days from the day on which you, or a third party other than the carrier and indicated by you, take physical possession of the last goods.

To exercise your right of withdrawal, you must inform us (MDS Handels- und Dienstleistungs-GmbH, Hammersteinstraße 1, 47807 Krefeld, Germany, email: info@livinda.de) of your decision to withdraw from this contract by means of a clear statement (e.g. a letter sent by post or an email). You may use the attached model withdrawal form, but this is not obligatory.

To meet the withdrawal deadline, it is sufficient for you to send your communication concerning your exercise of the right of withdrawal before the withdrawal period has expired.

Effects of withdrawal

If you withdraw from this contract, we shall reimburse to you all payments received from you, including the costs of delivery (with the exception of the supplementary costs resulting from your choice of a type of delivery other than the least expensive type of standard delivery offered by us), without undue delay and in any event not later than fourteen days from the day on which we are informed about your decision to withdraw from this contract. We will carry out such reimbursement using the same means of payment as you used for the initial transaction, unless you have expressly agreed otherwise; in any event, you will not incur any fees as a result of such reimbursement. We may withhold reimbursement until we have received the goods back or you have supplied evidence of having sent back the goods, whichever is the earliest.

You shall send back the goods or hand them over to us without undue delay and in any event not later than fourteen days from the day on which you communicate your withdrawal from this contract to us. The deadline is met if you send back the goods before the period of fourteen days has expired.

You will have to bear the direct cost of returning the goods.

You are only liable for any diminished value of the goods resulting from handling other than what is necessary to establish the nature, characteristics and functioning of the goods.

Cancellation policy – purchase of a sofa

For the purchase of a sofa, we extend the withdrawal period to 30 days.

Right of withdrawal

You have the right to withdraw from this contract within thirty days without giving any reason.

The withdrawal period is thirty days from the day on which you, or a third party other than the carrier and indicated by you, take physical possession of the last goods.

To meet the withdrawal deadline, it is sufficient for you to send your communication concerning your exercise of the right of withdrawal before the withdrawal period has expired.

Effects of withdrawal

You will have to bear the direct cost of returning the goods. These costs are estimated at a maximum of approximately CHF 350.00.

If, at the time of cancellation, the goods are already in transit and the withdrawal is made by refusing acceptance from the responsible carrier, we reserve the right to charge you the resulting transport costs incurred by us in the amount of CHF 350.00.

These costs arise independently of the statutory right of withdrawal if shipping has already been arranged and the goods are in the delivery process.

You are only liable for any diminished value of the goods resulting from handling other than what is necessary to establish the nature, characteristics and functioning of the goods.

Notice on the non-existence or expiry of the right of withdrawal

The right of withdrawal does not apply, among other things, to:

contracts for the supply of goods that are not prefabricated and for whose production an individual selection or specification by the consumer is decisive, or that are clearly tailored to the consumer’s personal needs, such as furniture customised using the configurator together with matching replacement covers;

contracts for the supply of sealed goods that are not suitable for return for reasons of health protection or hygiene, if their seal has been removed after delivery.
